Ownership of User Content §

Users retain all copyright in content they upload. By uploading content, users confirm they are either the original creator or hold a valid licence, assignment, or authorisation from the rights holder.

Tailorte does not claim ownership of User Content but requires the operational licence described in the Terms of Service to host and run the platform.

Permitted & Prohibited Content §

Permitted Content §

  • Original photographs you personally captured.
  • Fashion content you personally styled or co-created, with proper attribution.
  • Commissioned content for which you hold a written agreement granting upload rights.
  • Content licenced under Creative Commons or equivalent open licences, provided attribution requirements are met.
  • Behind-the-scenes content from productions in which you participated.

Prohibited Content §

  • Magazine editorial photography without express written licence from the publication.
  • Photographer portfolios or galleries copied without consent.
  • Brand campaign imagery without authorisation.
  • Content that reproduces substantial portions of another creator's work without transformation.
  • Screenshots or reposts of another creator's original content without explicit permission.

Copyright Infringement Notice (DMCA-Compatible) §

If you believe content on Tailorte infringes your copyright, submit a formal takedown notice. Your notice must include:

  1. Your full legal name and contact information (address, telephone, email).
  2. A description of the copyrighted work you claim has been infringed.
  3. The URL or specific location of the allegedly infringing content on Tailorte.
  4. A statement of good faith belief that the use is not authorised by the copyright owner, its agent, or the law.
  5. A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorised to act on their behalf.
  6. Your physical or electronic signature.

Submitting a false or bad-faith takedown notice may expose you to legal liability.

Counter-Notice Process §

If your content was removed and you believe the removal was in error, submit a counter-notice including:

  1. Your full legal name and contact information.
  2. Identification of the content that was removed and its prior location on Tailorte.
  3. A statement under penalty of perjury that you have a good faith belief the content was removed by mistake or misidentification.
  4. Your consent to the jurisdiction of a competent court in Germany for resolution of any dispute.
  5. Your physical or electronic signature.

Upon receiving a valid counter-notice, Tailorte will notify the original complainant. If no legal action is initiated within fourteen (14) business days, Tailorte may restore the removed content.

Repeat Infringer Policy §

Accounts terminated under this policy may not be re-registered by the same individual.

Trademark Policy §

Users may not:

  • Use another party's trademark in a manner likely to cause consumer confusion.
  • Register usernames or profile names incorporating protected brand names for deception or brand squatting.
  • Create content falsely implying official affiliation, endorsement, or partnership with a trademarked brand.

Trademark owners may report violations to legal@tailorte.com with proof of trademark ownership.

Design Rights & Fashion IP §

  • Reproduction of registered fashion designs without authorisation is prohibited.
  • Users may not publish content that facilitates commercial copying of protected designs or collections.
  • Commentary, criticism, or scholarly discussion of fashion designs is generally protected as fair use and is permitted.

Tailorte's Own Intellectual Property §

All platform elements including logos, interface design, typography, brand assets, and Tailorte's codebase are the exclusive intellectual property of Tailorte — Devpitch UG (haftungsbeschränkt). Unauthorised reproduction, modification, or use of Tailorte's IP is strictly prohibited and may result in legal action.

Safe Harbour & Platform Liability §

Tailorte operates as a hosting platform under applicable safe harbour provisions, including Article 14 of the EU E-Commerce Directive and Section 512 of the US Digital Millennium Copyright Act. Tailorte is not liable for infringing User Content it has not been notified about, provided it acts expeditiously upon receipt of a valid takedown notice.
